Slip and Fall Accident Lawyer in California Serving Clients in Glendale

Nobody likes to think about the risks of a slip and fall accident. However, according to a fact sheet from the National Floor Safety Institute (NFSI), slips and falls result in more than one million visits to emergency departments every year, and they are primarily responsible for lost days from work. Of all the injuries a person can sustain in a slip and fall incident, fractures are most common. Among older adults, hip fractures can be devastating, and they can sometimes lead to death. To be sure, falls are responsible for nearly 90 percent of fractures among seniors aged 65 and older, and about half of all seniors who suffer debilitating fractures cannot live independently anymore.

In many cases, these devastating falls could have been prevented if a homeowner or business owner had taken more care to ensure that fall-related hazards were remedied. If you or someone you love recently got hurt in a slip and fall accident, you should learn more about filing a claim for financial compensation by discussing your case with a Glendale slip and fall attorney.

In California, slip and fall lawsuits fall under a larger category of law known as premises liability law. To have a successful premises liability lawsuit, California law requires that the plaintiff is able to prove the following four elements:

  1. The defendant owned, leased, occupied, and/or controlled the property;
  2. The defendant was negligent in using or maintaining the property;
  3. The plaintiff was harmed; and
  4. The defendant’s negligence was a substantial factor in causing the plaintiff’s harm.

What makes a person negligent under the law? In Glendale, the law makes clear that a person has a basic duty of care when it comes to his or her property (whether she rents or owns it). That basic duty of care requirement means that a defendant can be negligent if she “fails to use reasonable care to keep the property in a reasonably safe condition.” The law also clarifies that property owners are required to “use reasonable care to discover any unsafe conditions and to repair, replace, or give adequate warning of anything that could be reasonably expected to harm others.”

In other words, a property owner has a duty to fix dangerous conditions or to warn people about those dangerous conditions. If a property owner fails to take either of these steps, then she may have failed to provide a basic duty of care and thus may be liable for injuries that result from the dangerous conditions on the property.

Personal Injury Law Statute of Limitations

It is important to file your claim as soon as possible. Under California law, most slip and fall accident victims will be required to file a lawsuit within two years from the date of the injury. If the injury victim does not file a claim within this specific period of time, she may not be eligible to receive financial compensation.
