Not The Actual ChildDespite being struck by an SUV and being thrown 25 feet, a 9-year-old boy is being declared a miracle by doctors, who expect him to make a long and difficult recovery, but a recovery nonetheless. While sustaining extensive injuries to his body, doctors reported that the boy’s head and neck were uninjured by the collision – a major factor in the boy surviving the ordeal.

According to reports, surveillance footage from a business near where the accident occurred shows the boy pressing the button next to a crosswalk to activate the “walk” signal. It also shows two other cars stopping to allow the boy to cross, and finally captures the moment where a third vehicle – a white SUV – struck the boy as he walked. The accident occurred in Stockton, CA on Wednesday, February 14th, 2013.

After the Collision

The driver of the white SUV that struck the 9 year old boy reportedly stopped her car and dialed 911 immediately following the accident. She cooperated with police and was released – no criminal charges are expected to be filed against the woman, but the investigation remains open.

An Especially Sensitive Matter

Having a child who sustains any kind of serious injury can be an emotional roller coaster for parents. Parents of child injury victims are likely to feel sadness, anger, remorse, fear, and a host of other emotions – sometimes all at once. If their child is ever the victim of a serious injury, parents are advised to seek immediate medical attention for the child, followed by sound legal counsel.

While an injury to a child can be especially heart-wrenching, children have the same rights to recovery as adults, and parents are usually allowed to seek compensation for their child’s injuries from those responsible. If parents can show that their child’s injuries were the result of another person’s recklessness or negligence, the injured victim may be able to recover monetary compensation for injuries sustained, medical expenses, pain and suffering, and certain other damages allowed by law. Each case will be different, which is why sound legal counsel should be sought following the infliction of any serious injury.

Putting the Case Together

One reason parents will want an attorney on their side following the infliction of serious injury to one of their children is because crafting a legal argument against reckless or negligent parties is a delicate procedure that requires the help of skilled litigators. In a case involving a seriously injured child, there is evidence that has to be reviewed, witnesses that have to be interviewed, police records which have to be acquired, and a host of other tasks which must be accomplished before parents can stand chance of obtaining maximum compensation.  Plus, after an emotionally trying experience such as a child involved in pedestrian accident, it is often better for parents to let professionals handle the legal side of matters while the child recovers.

Even though they may want to help, the best thing for parents to do in a situation like this is to focus on their child while legal professionals focus on their case.
