It was not long ago that up to 25,000 people were killed every year in drunk driving crashes. While there has been a significant decline in drunk driving fatalities over the previous three decades, drunk driving is still a serious problem in California. According to Mothers Against Drunk Driving (MADD), 29 percent of California traffic fatalities are caused by drunk drivers. Cars have become safer, police enforcement has increased, and social pressure to abstain from driving while drunk has helped to save thousands of lives. Yet, in the 10-year span from 2003 to 2012, there were 10,327 casualties of the drunk driving epidemic in California, according to the Centers for Disease Control and Prevention (CDC).

Even Small Levels of Blood Alcohol Content Cause Crashes

While anything at or above 0.08 BAC is illegal in all 50 U.S. states, research has proven that even levels as low as 0.04 significantly impair a person’s judgment and reaction time. Any amount of alcohol in the blood system is unsafe when driving a motor vehicle. Sadly, many DUI-caused fatalities result from BACs much higher than 0.08, with most fatal crashes being caused by driver’s with BACs over 0.1. The Penalties for Drunk Driving in California: Not Enough to Deter DUI Drivers

While the financial cost of dealing with a DUI (Driving Under the Influence) is high for the individual, the legal and financial costs are not high enough to deter repeat offenders. According to California Courts,  a first time DUI offender can expect to spend between four days and six months in jail, 10 days to one year for a second offense, and 120 days to one year for a third offense. However, these maximum jail sentences are rarely given. Serious fines and expenses for traffic school are usually incurred, as well, as are license suspensions. Yet, repeat offenders always seem to get back behind the wheel all too soon. According to MADD, one-third of all drivers convicted of driving while intoxicated are repeat offenders. And, the average convicted drunk driver has driven while intoxicated 80 times before their first DUI arrest. The chances that the driver who caused your injuries had driven drunk before are extremely high. Make no mistake, this was not a one-time “accident” on their behalf.
